Waste Collection Richmond Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Richmond provides waste collection and related services to residential and commercial customers. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any waste collection, clearance, disposal or related service provided by Waste Collection Richmond.

1.2 Customer, you or your means the person, business or organisation requesting or receiving the Service.

1.3 We, us or our means Waste Collection Richmond, the service provider.

1.4 Waste means any items, materials, rubbish, refuse or goods presented for removal, collection or disposal under the Service.

1.5 Booking means a request by the Customer for the provision of the Service, whether made online, by telephone, by email or in person.

1.6 Contract means the legally binding agreement between the Customer and us for the provision of the Service, incorporating these Terms and Conditions.

2. Scope of Service

2.1 We provide waste collection and related services within our designated service area, which includes Richmond and surrounding locations as notified by us from time to time.

2.2 The specific Service to be provided, including the type of waste collection, the estimated volume or weight of waste, and the scheduled date and time, will be agreed at the time of booking.

2.3 We reserve the right to refuse to collect any Waste that is not accurately described at the time of booking, that is hazardous or prohibited, or that in our reasonable opinion may pose a health and safety risk.

2.4 Our obligation is to collect and arrange for lawful disposal or recycling of Waste in accordance with applicable waste management and environmental regulations in the United Kingdom.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online booking system where available.

3.2 When placing a booking, you must provide accurate and complete information, including:

(a) your name, contact details and address where the Service will be carried out;

(b) an accurate description of the Waste to be collected, including its approximate volume, weight and nature; and

(c) any access restrictions, parking limitations or other circumstances that may affect the Service.

3.3 Your booking constitutes an offer to purchase the Service. The Contract is formed when we confirm acceptance of your booking and provide you with a booking confirmation, which may be given verbally, by email or in writing.

3.4 We may refuse or cancel a booking at our discretion, including where we believe the Waste to be hazardous, the information provided is inaccurate, or the Service cannot be safely or lawfully carried out.

4. Access, Parking and Your Responsibilities

4.1 You must ensure that we have safe and reasonable access to the property and Waste at the agreed time of the Service.

4.2 You are responsible for obtaining any necessary parking permissions, permits or dispensations required for our vehicles to access your property. Any parking charges or penalties incurred as a result of insufficient permissions may be charged to you.

4.3 You must ensure that the Waste is readily accessible, clearly separated from items not intended for collection, and presented in a safe and manageable manner.

4.4 You warrant that you either own the Waste or have the full authority of the owner to arrange its removal and disposal.

4.5 You agree to provide any information reasonably requested by us to enable us to comply with waste regulations and to carry out the Service safely and lawfully.

5. Waste Types and Prohibited Items

5.1 We collect general household and commercial waste, bulky items, garden waste and other non-hazardous materials, subject to prior agreement.

5.2 Certain items are prohibited or require special handling, including but not limited to:

(a) asbestos and asbestos-containing materials;

(b) chemicals, solvents, oils, paints and corrosive substances;

(c) medical or clinical waste, sharps and biological materials;

(d) gas cylinders, fuel, explosives and pressurised containers;

(e) electrical and electronic equipment where specific regulatory schemes apply; and

(f) any other hazardous or controlled waste as defined by UK legislation.

5.3 You must declare any potentially hazardous or restricted items at the time of booking. We may, in our discretion, agree to handle such items subject to additional charges, conditions and legal requirements.

5.4 If we discover prohibited or undeclared hazardous items during the Service, we may refuse to collect them, adjust the price, or terminate the Service. You may be responsible for any resulting costs, including safe disposal and additional labour or transport.

6. Pricing, Quotations and Payments

6.1 Prices for our waste collection services are based on factors including the type of Service, the nature and quantity of Waste, access conditions and location within our service area.

6.2 Any quotation provided before the Service is an estimate based on the information you supply. If, upon arrival, the Waste or conditions differ from those described, we may adjust the price accordingly before proceeding.

6.3 Unless otherwise agreed in writing, payment is due on completion of the Service. We may require a deposit or full payment in advance for certain bookings, large collections or commercial accounts.

6.4 Payment can be made by accepted card, cash or bank transfer, as notified by us. We reserve the right to refuse cheques.

6.5 All prices are stated inclusive or exclusive of VAT as specified at the time of booking. Where VAT applies, it will be charged at the prevailing rate.

6.6 If you fail to make payment when due, we may charge interest on any overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us during our normal business hours.

7.2 If you cancel more than 24 hours before the scheduled Service time, any pre-paid amounts may be refunded or credited at our discretion, subject to the deduction of any non-recoverable costs.

7.3 If you cancel less than 24 hours before the scheduled Service time, fail to provide access, or are not present where your presence is required to identify or authorise collection of Waste, we may charge a cancellation fee up to the full price of the booked Service.

7.4 We will use reasonable endeavours to accommodate requests to amend the date, time or scope of the Service. Changes may be subject to availability, price adjustments and administrative charges.

7.5 We may cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, road closures or safety concerns. In such cases, we will seek to agree a new service date with you, and our liability will be limited to the re-arrangement of the Service or a refund of any pre-paid amounts for the cancelled Service.

8. Performance of the Service

8.1 We will use reasonable skill and care in providing the Service and will take reasonable steps to minimise disruption to your property.

8.2 Time of performance is not of the essence. Any time or date for collection provided by us is an estimate only, and we do not accept liability for any losses arising from delay, provided we perform the Service within a reasonable time.

8.3 You or your representative may be asked to confirm, before and after the Service, the Waste to be collected and the areas to be cleared. You must check that the correct items have been removed before our team leaves the site.

8.4 Once the Waste has been removed, it becomes our property and we will arrange for its reuse, recycling, recovery or disposal in accordance with applicable law.

9. Compliance with Waste Regulations

9.1 We will carry, handle and dispose of Waste in accordance with all applicable UK laws, regulations and codes of practice relating to waste management, environmental protection and duty of care.

9.2 Where required, we will hold appropriate waste carrier registration and will use only authorised facilities for the treatment, recycling or disposal of Waste.

9.3 You acknowledge your duty of care with respect to the Waste you produce or control and agree to cooperate with us in providing any necessary information for documentation, including the nature, origin and composition of the Waste.

9.4 You must not request us to collect or dispose of Waste in any manner that would constitute a breach of applicable regulations. If you do so, you will indemnify us for any fines, penalties, costs or losses we suffer as a result.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be limited or excluded.

10.2 Subject to clause 10.1, we will not be liable for:

(a) loss of profits, business, revenue or anticipated savings;

(b) loss of or damage to goodwill or reputation; or

(c) any indirect or consequential loss or damage, in each case arising out of or in connection with the Service or the Contract.

10.3 Our total aggregate liability to you in respect of all claims arising out of or in connection with the Service or the Contract, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable by you for the specific Service giving rise to the claim.

10.4 You must notify us in writing of any claim for loss or damage to property within 48 hours of completion of the Service, providing reasonable details of the alleged loss or damage. We may inspect the property and investigate the circumstances before accepting liability.

10.5 We will not be liable for any damage caused by pre-existing defects, structural weaknesses, poor installation, or items that are fragile, poorly assembled or not fit to be moved.

11. Customer Indemnity

11.1 You agree to indemnify and keep us indemnified against all liabilities, costs, claims, expenses, damages and losses arising from:

(a) your breach of these Terms and Conditions;

(b) your failure to provide accurate information about the Waste, access or site conditions;

(c) the presence of hazardous, prohibited or undeclared Waste at the collection site; and

(d) any claim made by a third party alleging that the Waste did not belong to you or that you did not have authority to arrange its removal.

12. Data Protection and Privacy

12.1 We will collect and process personal information about you for the purposes of administering bookings, providing the Service, managing payments and complying with legal obligations.

12.2 We will handle your personal information in accordance with applicable data protection laws in the United Kingdom and our internal policies. We will not sell your data to third parties.

13. Complaints and Dispute Resolution

13.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible with details of your complaint.

13.2 We will investigate complaints in good faith and seek to resolve them promptly, which may include rectifying issues where reasonable and appropriate.

13.3 Nothing in this clause limits your statutory rights as a consumer, where applicable.

14. Variations to these Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, operational needs or legal requirements.

14.2 The Terms and Conditions in force at the time you make your booking will apply to that Contract, unless a change is required by law or regulatory authority, in which case the updated terms may apply to existing bookings.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be treated as deleted, but the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
